The Ministry of Public Health issued its Notification Re: Specification of Type 5 Narcotics B.E. 2563 (2020) (“Notification”) on 8^th December 2020 to exclude certain parts of cannabis and hemp from the Type 5 Narcotics under the Narcotics Act B.E. 2522 (1979) as amended (“NA”).  The Notification was published in the Government Gazette on 14^th December 2020 and became effective from 15^th December 2020.

The following parts of cannabis and hemp planted by the authorized producers under the NA are now excluded from the Type 5 Narcotic list:-

1.   the rind, stem, fiber, petiole, root, leaf with no treetop or inflorescence of cannabis, its extract with Cannabidiol (“CBD”) and Tetrahydrocannabinol (“THC”) of not more than 0.2% by weight, and the remaining from cannabis extract with THC of not more than 0.2% by weight; and

2.   the rind, stem, fiber, petiole, root, leaf with no treetop or inflorescence of hemp, its extract with CBD and THC of not more than 0.2% by weight, hemp seeds, hemp seed oil, hemp seed extract, and the remaining from hemp extract with THC of not more than 0.2% by weight.

The importation of the parts mentioned above remains subject to the NA, except for the dried rind, dried core of the stem and dried fiber of the cannabis and hemp.
