Rules on 3rd October 2017, the Myanmar Investment Commission (“MIC”) issued the Announcement on Appointment of Foreign Experts for transparency and simplification of the procedures for appointment of foreign experts in line with the Myanmar Investment Law 2016 (“MIL”). On 15th November 2017, the MIC also issued the Explanation on Appointment of Foreign Experts for foreign investment companies in Myanmar operating under the MIC permits (“MIC Company”).

Under the said Announcement and Explanation, an MIC Company operating in Myanmar can appoint foreign experts to work for the Company pursuant to the MIL and the Myanmar Investment Rules 2017. A request for the appointment of foreign experts must be made prior to the arrival date or within 7 working days after the date of arrival of such foreign experts. If the appointed foreign expert resigns before or after the expiration date of his employment contract, the MIC Company must notify the DICA for approval of the resignation of foreign experts.
