After the Notification of the Ministry of Public Health re: Specification of Type 5 Narcotics B.E. 2565 (A.D. 2022) entered into force on 9^th June 2022 to delete most parts and forms of cannabis (marijuana and hemp) and their extracts containing no more than 0.2% by weight of tetrahydrocannabinol (“THC”) from the Type 5 narcotics under the Narcotics Act B.E. 2522 (A.D. 1979), the Ministry of Public Health issued its Notification re: Controlled Herb (Marijuana) B.E. 2565 dated 16^th June 2022 effective on and from 17^th June 2022 to:

(1)   classify marijuana and its extracts as a controlled herb under the Protection and Promotion of Knowledge on Thai Traditional Medicine Act B.E. 2542 (A.D. 1999);

(2)   allow persons of not less than 20 years of age to possess, use, take care of (tend), store, transport, and distribute marijuana and its extracts, except for:

(a)  smoking marijuana in the public places,

(b)  consuming marijuana by pregnant women and breastfeeding women,

(c)  distributing marijuana to persons of less than 20 years of age, pregnant women or breastfeeding women;

(3)   allow prescriptions of marijuana and its extracts as drugs for patients by medical practitioners, Thai traditional medical practitioners, applied Thai traditional medical practitioners, Chinese traditional medical practitioners, and Thai folk medical practitioners; and

(4)   allow patients of the practitioners mentioned under (3) above to possess, transport, take care of (tend), store, and use marijuana and its extracts as prescribed drugs for 30 days.
